1. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Bishunpura P.S. Case No. 05 of 2026 for the offence registered under Section 376, 385, 323 of Indian Penal Code, now said to have been pending in the court of learned Sub-Divisional Judicial Magistrate, Nagar Untari.

Learned counsel for the petitioner, while referring to the complaint, which was sent for investigation, has submitted that the allegation of rape against the petitioner has been made by the victim as back as on 14.01.2022 and there was complete silence thereafter and subsequently another allegation has been made, which is dated 30.03.2024, wherein the victim is said to have been threatened and it is alleged that the victim was also raped. The learned counsel submits that the complaint was filed on 20.05.2024. He has further submitted that the present case is a counter blast of the case lodged by the wife of the petitioner against the husband of the victim involved in the present case. He submits that charge-sheet has already been submitted and the petitioner is in custody since 29.04.2026.

3. Learned counsel for the opposite party has opposed the prayer for bail and has submitted that the victim did not receive the notice. However, the aforesaid submissions, made by the learned counsel for the petitioner based on the materials on record, are not in dispute.

After hearing the learned counsel for the parties and there appears to be some element of enmity between the two and the fact that the charge-sheet has already been submitted and the petitioner is in custody since 29.04.2026, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Nagar Untari in connection with Bishunpura P.S. Case No. 05 of 2026, subject to the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶19

(iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner would deposit a self-attested copy of his Aadhar Card along with his Mobile Number before the learned court below, which he shall not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

5. The instant bail application is allowed with the aforesaid conditions.

6. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘email/FAX’.
