03 /09.07.2026 Heard the learned counsel appearing on behalf of the parties.

2. Learned counsel for the petitioners submits that the petitioners are in custody in connection with Lawalong P.S. Case No. 47 of 2023 for the offences registered under Sections 376D, 506 and 34 of IPC, pending in the court of learned Additional District Judge-II, Chatra.

3. Learned counsel for the petitioners submits that the petitioners are in custody since 05.05.2026 and charge sheet has already been submitted under Section 354 of IPC.

4. The learned counsel submits that the co-accused who are facing trial under Section 376D/506/34 of IPC have been enlarged on bail by co-ordinate Benchs.

Other co-accused namely Maksud Miyan and Hussain Miyan who are similarly situated as that of the petitioner against whom charge sheet has been submitted under Section 354 IPC have also been enlarged on bail by this court vide order dated 06^th July, 2026 in B.A. No. 6251 of 2026.

5. Learned counsel for the opposite party-State has opposed the prayer for bail, however, the aforesaid submissions made by the counsel for the petitioner is not in dispute.

In view of the fact that charge sheet has been submitted under Section 354 IPC and the other similarly situated co-accused against whom also charge sheet has been submitted under Section 354 IPC have been enlarged on bail as stated above, the petitioners above named are directed to be enlarged on bail on his furnishing bail bond

of Rs. 25,000/- (Rs. Twenty-five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Chatra, in connection with Lawalong P.S. Case No. 47 of 2023, on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioners.

(ii) The other bailor should be his close relative.

(iii) The petitioners will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioners.

(iv) The petitioners will deposit a self-attested copy of their Aadhar Card along with their mobile number before the learned court which they will not change during the pendency of the case without prior permission of the court.

(v) The petitioners shall fully co-operate with the proceedings before the learned court below.

7. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/email.

8. The instant bail application is allowed with the aforesaid conditions.
