02/03.07.2026 Heard learned counsel for the applicant and the learned A.P.P appearing for the State.

The applicant, who is in custody since 29.07.2025, has renewed his prayer for grant of regular bail in connection with S.T. Case No. 427 of 2025 arising out of Lesliganj P.S. Case No.114 of 2024, registered for the offence under Sections 103(1), 238(b), 3(5) of the BNS, 2023, pending in the court of learned District & Additional Sessions Judge-I, Palamau at Daltonganj.

It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. along with its enclosures have been annexed with this bail application and there is no suppression on his/her part.

It has been submitted by the learned counsel for the applicant that earlier the prayer for bail of the applicant has been rejected by this Court vide order dated 16.03.2026 passed in B.A. No. 12159 of 2025.

It has been submitted by learned counsel for the applicant that the only evidence against the applicant is confession of the co-accused and there is no other material against the applicant. Some of the witnesses have been examined but no worth material has come against the applicant to connect him with the crime.

Learned counsel for the State and the learned counsel for the informant have opposed the prayer for bail of the applicant. It has been submitted that this applicant has helped the main accused in commission of the crime.

Considering the fact that except the confession of the co-accused, there is no material on record and also considering period of custody

undergone by the applicant, I am inclined to enlarge the applicant on bail.

Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-1, Palamau at Daltonganj in connection with S.T. Case No. 427 of 2025 arising out of Lesliganj P.S. Case No.114 of 2024, subject to condition that the applicant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
