Heard the parties.

The Officer-in-Charge of Daltonganj Town police station is present in the court physically.

A counter affidavit is filed on behalf of the State.

Vide order dated 04.06.2026, a coordinate Bench of this Court directed the Officer-in-Charge to remain physically present in the Court today to explain as to under what circumstances despite the efforts made by the learned Spl. P.P. and despite the order of this Court, he has not sent the case diary to the learned Spl. P.P.

It is submitted by the learned Spl. P.P. that the Officer-inCharge of Daltonganj Town police station has tendered an unqualified and unconditional apology for non-submission of the case diary in time and in fact the required documents were forwarded to the Nodal Officer through WhatsApp on 04.06.2026 at 09:23 am but since the case was taken up in the meanwhile, the same could not be produced before the Court and submits that unconditional apology be accepted.

Considering the submissions made, the apology tendered by the Officer-in-Charge of Daltonganj Town police station namely Jyoti Lal Rajwar is accepted.

The personal appearance of the said Officer-in-Charge of Daltonganj Town police station is dispensed with.

Learned counsel for the petitioner submits that the petitioner seeks permission of this Court to withdraw this bail application.

Accordingly, this bail application is dismissed as withdrawn.
