Bishwa Oraon Vs the State of Jharkhand

2. Learned counsel for the petitioners submits that the petitioners are in custody since 11.03.2026 in connection with Bishunpur P.S. Case No. 06 of 2026 for the offences registered under Sections 103 (2)/3(5) of Bharatiya Nyaya Sanhita (BNS) 2023, pending in the court of learned Judicial Magistrate 1^st Class, Gumla.

3. Learned counsel for the petitioners submits that as per the allegation, the petitioners and others had indulged in killing the victim on the allegation that she was a child lifter. He submits that there is general and omnibus allegation and except the confessional statement, there is nothing against the petitioners. He submits that similarly situated co-accused namely Shiblal Oraon has been enlarged on bail by a co-ordinate Bench of this court vide order dated 04.06.2026 in B.A. No. 4941 of 2026.

4. Learned counsel for the opposite party-State has opposed the prayer but does not dispute the fact that apart from confessional statement, there is nothing against the petitioners.

After hearing the learned counsel for the parties and considering the fact that co-accused has been enlarged on bail and the case of the petitioners stand on similar footing, the petitioners above named are directed to be enlarged on bail on their furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Gumla in connection with Bishunpur P.S. Case No. 06 of 2026, on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioners.

(ii) The other bailor should be their close relative.

¶19

(iii) The petitioners will attend the court on each and every date and on account of their single default, the learned court shall cancel the bail bond furnished by the petitioners.

(iv) The petitioners will deposit a self-attested copy of their Aadhar Card along with their mobile number before the learned court which they will not change during the pendency of the case without prior permission of the court.
