the State and learned counsel appearing for the victim.

The petitioner is apprehending his arrest in connection with Kuru P.S. Case No. 44 of 2026, registered for the offence under Sections 126(2), 118(1), 109, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Lohardaga.

Learned counsel appearing for the petitioner submits that the informant is own aunty of the petitioner and the present case is a direct consequence of a land dispute existing in the family. He next submits that the land, on which, the informant's husband went to plough is the exclusive property of the petitioner, being situated at Mauza-Pandra under Khata No.171, Plot No.780, area 1.19 acres which the petitioner's mother got by way of mutual partition. He then submits that she remained in the peaceful possession and subsequently by virtue of a duly executed registered sale deed no.276/272 dated 25.2.2022 transferred the said land in favor of her son (petitioner herein) and despite having no right title, interest or possession over the

said land, the informant's husband unlawfully entered upon the property and attempted to interfere with the petitioner's possession. He also submits that one Partition Suit is pending between the husband of the informant and the petitioner, being Original Suit No. 26 of 2022, which is pending in the court of learned Civil Judge (Sr. Div), Lohardaga. He further submits that the nature of injury is not disclosed in the order of the learned Sessions Judge. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner.

Learned A.P.P. appearing for the State and learned counsel appearing for the victim, who happened to be the husband of the informant have jointly opposed the prayer and submit that the allegations are there of making assault. Learned counsel appearing for the victim further adds that the independent witnesses have supported the case. On these grounds, they submit that anticipatory bail may kindly be rejected.

In course of argument, it has been pointed out that there are case and counter case between both the sides and both the sides have received injuries and further the altercation took place due to land dispute and the mother of this petitioner has transferred the land in question and one title suit, being Original Suit No. 26 of 2022 is still pending in the court of learned Civil Judge (Sr. Div), Lohardaga between the parties and further the nature of the injury has not come in the order of the learned Sessions Judge.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, above named.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on

bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Lohardaga, in connection with Kuru P.S. Case No. 44 of 2026, subject to conditions as laid down under Section 482 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
