The petitioner is apprehending his arrest in connection with Complaint Case No. 32487 of 2024, registered for the offence under Sections 47(a) of the Excise Act, pending in the court of learned Additional Chief Judicial Magistrate, Ranchi.

Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the recovered 1600 Kg. of Jawa Mahua and 35 liters of prepared Jawa Mahua wine and that has been recovered from the forest area. He further submits that the petitioner has been falsely implicated in the case only on suspicion and the petitioner is having no criminal antecedent as disclosed in para 10 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that the name of the petitioner has come on suspicion.

Considering that the said recovery has been made from the forest area and the name of the petitioner has come only on suspicion and the name of the person who has taken the name of the petitioner, that person’s name has not been disclosed in the FIR and further the petitioner is having no criminal antecedent as disclosed in para 10 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ranchi, in connection with Complaint Case No. 32487 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
