The petitioner is apprehending his arrest in connection with Kasmar P.S. Case No. 83 of 2023 corresponding to G.R. No.1113 of 2023, registered for the offence under Section 395 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1^st Class, Bermo at Tenughat.

Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the confessional statement of the apprehended co-accused and the petitioner is having no criminal antecedent as disclosed in para 10 of the petition. He next submits that in identical situation another co-accused has been granted anticipatory bail by this court in A.B.A. No.1860 of 2024. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that name of the petitioner has come on the confessional statement.

Considering the fact that name of the petitioner has come on the confessional statement of the apprehended co-accused and the petitioner is having no criminal antecedent as disclosed in para 10 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond
