02 /11.06.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.

2. The petitioners are apprehending their arrest in connection with Chirkunda (Maithan O.P.) P.S. Case No.48 of 2026, for the alleged offences registered under Sections 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Dhanbad.

3. Learned counsel appearing for the petitioners submits that from the pickup van iron ore was recovered and the owner-cumdriver of the said pickup van has stated that he has taken the said iron ore from the petitioners. He further submits that however the

petitioners have nothing to do with the said iron ore. He then

submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.20 of the petition.

4. Learned counsel appearing for the State opposed the prayer and submits that the owner-cum-driver of the pickup van has taken the name of the petitioners.

Considering that only on the basis of the statement of owner-cum-driver of the said pickup van, who were carrying iron ore, the petitioners have been implicated in this case and iron ore of the petitioners have been denied by learned counsel appearing for the petitioners and the petitioners have got no criminal antecedent as disclosed in paragraph No.20 of the petition, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dhanbad in connection with Chirkunda (Maithan O.P.) P.S. Case No.48 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
