Petitioner, aged about 32 years, accused under Sections 15(C), 22 & 29 of the NDPS Act in Balumath P.S. Case No.227 of 2019 corresponding to N.D.P.S. Case No.17 of 2025, had his first regular bail prayer rejected on 02.05.2025 in B.A. No.3566 of 2025. Fresh ground: four witnesses examined and declared hostile, who did not support the prosecution case despite leading questions; bail allowed considering that fact and the period of custody undergone. Heard the parties.

The petitioner has been made accused in connection with Balumath P.S. Case No.227 of 2019 corresponding to N.D.P.S. Case No.17 of 2025 registered for the offences punishable under Sections 15(C), 22 & 29 of the NDPS Act.

This is the second journey of the petitioner with the prayer for regular bail, earlier the prayer for regular bail of the petitioner was rejected vide order dated 02.05.2025 in B.A. No.3566 of 2025.

Learned counsel for the petitioner submits that the fresh ground is that in the meanwhile, four witnesses have been examined and all the four witnesses have stated that they did not know anything about the case and have been declared hostile and though they were declared hostile and the prosecution put leading question to them, still they did not support the case of the prosecution.

Considering the aforesaid facts and the period of custody undergone by the petitioner, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Latehar in connection with Balumath P.S. Case No.227 of 2019 corresponding to N.D.P.S. Case No.17 of 2025 with the condition that he will co-operate

with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case .
