This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure with the prayer to quash and set aside the entire criminal proceeding including the FIR in connection with Lalpur P.S. Case No.125

of 2022 registered for the offences punishable under Sections 420/406 of the Indian Penal Code against the petitioner.

The allegation against the petitioner is that the petitioner cheated the informant and his relatives by deceiving them to invest money in Online Satta Live Casino and with dishonest and fraudulent intention induced them to invest money and made them part with money by way of cheating, but depositing money in the name of several companies and has also cheated several other persons.

On the basis of the written report submitted by the informant, police registered Lalpur P.S. Case No.125 of 2022 and took up investigation of the case.

Learned counsel for the petitioner submits that the investigation of the case is still going on and the allegations against the petitioner are vague and false. It is next submitted that the date or time of entrustment of money has not been mentioned and even the mode of the payment has also not been mentioned. It is next submitted that the informant has not disclosed as to what type of entity or the organization in which he has invested money. It is lastly submitted that the prayer as prayed for in this Cr.M.P., be allowed.

Learned Addl.P.P. appearing for the State on the other hand vehemently opposes the prayer of the petitioner made in the instant Cr.M.P and submits that there is direct and specific allegation against the petitioner of committing cheating of gullible persons by making them invest money on Online Gaming and Satta Platforms illegally and the

petitioner and the co-accused person, not only cheated the informant but the allegation is that they have also cheated several persons of India. Hence, keeping in view the serious nature of allegation against the petitioner and as the investigation of the case is still going on, the entire criminal proceeding ought not be quashed at this nascent stage. Therefore, it is submitted that this Cr.M.P., being without any merit, be dismissed.

Having heard the rival submissions made at the Bar and after carefully going through the materials available in the record, this Court finds that there is direct and specific allegations against the petitioner of not only cheating the informant but also cheating several other persons through online gaming portals and the investigation of the case is still going on and in view of the direct and specific allegation against the petitioner, this Court is not inclined to quash the entire criminal proceeding at this nascent stage.
