The petitioner is apprehending his arrest in connection with Cyber P.S. Case No. 199 of 2024, registered under sections 75, 77, 79, 78 of the BNS and under sections 67/67A of the I.T. Act, pending in the Court of learned Additional Judicial Commissioner-II-cum-Special Judge, Cyber Crime, Ranchi.

Learned counsel for the petitioner submits that petitioner and informant were in friendship and false allegations are made of uploading obscene photograph of the informant on fake face-book account. He next submits that what has happened that is consensual in nature. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that so far uploading of obscene photograph of the informant on fake facebook account is concerned, that has come in para 22 of the case diary. However, they were in relationship but allegations are serious and in view of that anticipatory bail of the petitioner may kindly be rejected.

Having friendship is one aspect however, taking away the dignity of a woman is serious matter. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail is hereby rejected.
