02/08.06.2026 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Jasidih P.S. Case No. 375 of 2025, registered for the offence under Sections 126(2), 115(2), 109, 303(2), 308(3), 74, 351(2), 352, 324(4) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Deoghar.

Learned counsel appearing for the petitioner submits that the petitioner was doing the levelling work by JCB machine on his own plot being Plot No.919 having area 01 acre. He next submits that the allegations are made of assault however, injury has not been found and that has come in the order of the learned Sessions Judge. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of carrying the said levelling work on the point of arms and the petitioner is having criminal antecedents. In that view of the matter, she submits that the anticipatory bail may kindly be rejected.

Considering that the said plot is said to be of the petitioner and the petitioner is the descendent of Raiyat, Biru Mahto, the allegation of assault are there however, in para 35 of the case dairy and it has been noted in the order of the learned Sessions Judge that only push was made by the petitioner and no injury is there and further, it is well settled that the criminal antecedent cannot be sole ground for either rejecting or allowing

the anticipatory or regular bail application, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Deoghar, in connection with Jasidih P.S. Case No. 375 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
