The petitioner is apprehending his arrest in connection

with Jirwabari PS Case No.207 of 2025, for offence registered under section 103, 61(2), 238, 303(2), 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Sahibganj.

Learned counsel for petitioner submits that initially the complaint case was filed by the complainant/informant alleging therein that this petitioner was involved in death of son of the complainant which has been subsequently converted into the FIR pursuant to the order of the Court. He next submits that the police has investigated the matter and by the last order, the case diary was called for. He next submits that in paragraph nos.9 and 14 of the case diary, it has come that the death has occurred due to accident and on these grounds, he submits that the petitioner has been falsely implicated in this case as there is some loan transaction between the petitioner and son of the informant and in view of that

anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that this is a case under section 103(2) of BNS, 2023.

On query made by the Court, learned counsel for the respondent State fairly submits that in paragraph nos.9 and 14 of the case diary, the accident aspect has come from the mouth of the witnesses.

Considering that in paragraph nos.9 and 14 of the case diary, it has come that the death has occurred due to accident, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Jirwabari PS Case No.207 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
