The instant Writ Petition has been filed under Article 226 of the Constitution of India for the following relief(s):-

a. For quashing the minutes of the proceeding of Liability Committee of Road Construction Department dated 9.01.2013, as contained in Annexure-11 to this Writ Petition, whereby and whereunder, the admitted claim of the petitioner for payment of admitted dues amounting to Rs.12,09,304/- has been rejected;

b. For quashing the reasoned order, contained in Memo No.551 (S) dated 17.01.2013 passed by the Engineer-in-Chief, Road Construction Department, Government of Jharkhand-

Respondent No.3, as contained in Annexure-12 to this Writ Petition;

c. For paying the admitted dues of the petitioner amounting to Rs.12,09,304/- along with interest @10% per annum from the date the said amount is due till the date of payment in terms of the earlier order dated 25.01.2012 passed by the Hon’ble High Court in the Writ Petition filed by the petitioner being W.P. [C] No.617 of 2009;

After argument at length, learned counsel for the petitioner seeks permission to withdraw the instant Writ Petition with a liberty to move before the competent court having civil jurisdiction.

Learned AC to GP.I for the State has no objection.

Accordingly, the instant Writ Petition is dismissed as withdrawn with aforesaid liberty to the petitioner.
