The petitioner is apprehending his arrest in connection with Jasidih P.S. Case No. 47 of 2026, registered under sections 126 (2), 115(2), 109, 303(2), 308 (3), 351(2), 352, 3(5) of BNS, 2023, pending in the Court of learned Additional Chief Judicial Magistrate, Deoghar.

Learned senior counsel for the petitioner submits that godown in question is in possession of one Bikash Kumar Ray and there is dispute with regard to possession of godown between Vikas Roy and informant. He next submits that petitioner is working with Bikash Kumar Ray. By way of annexing electricity bill with the supplementary affidavit the learned senior counsel for the petitioner submits that the said electricity bill is in the name of Bikash Kumar Ray. He submits that now good sense has prevailed between informant and Bikash Kumar Ray and they have compromised the case. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of going to the godown and demanding money.

Learned counsel for the informant submits that Bikash Kumar Ray and informant have settled the dispute.

Considering that petitioner is employee of Bikash Kumar Ray and dispute is between Bikash Kumar Ray and informant and further informant and Vikas Roy have settled the dispute.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/(twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Deoghar, in connection with Jasidih P.S. Case No. 47 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
