By way of this bail application, the petitioner prays for grant of regular bail in connection with Lalpur Police Station Case No.05 of 2026 (arising out of Garhwa Police Station Case No.00 of 2026), registered for offences alleged under Sections 126(2), 115(2), 109(2), 103(1), 352, 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the Judicial Magistrate XXXII at Ranchi.

First Information Report being Lalpur Police Station Case No.05 of 2026 was registered on the basis of Garhwa Police Station Case No.00 of 2026, which was registered on the written report filed by the informant. It has been alleged that the informant along with the deceased and two of his friends had been to Moon Disco Bar Near Lalpur Chowk. They had feast there and when they came out of the Bar at around 12.00 night, it is alleged that there was altercation between the informant group and persons from another group who also were at the Bar. As a result, the deceased was severely assaulted by the persons from another group. In between one person from the another group took his vehicle bearing No. JH01GD 2216 from the other side of the road and tried to dash the persons from informant group with an intention to kill them due to which the deceased suffered injuries and fell down. Thereafter the said vehicle once again crushed the deceased by trampling him with the vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner is not named in the First Information Report nor was present at the place of occurrence. He submits that no overt act or any specific allegation has been attributed against the present petitioner. According to the petitioner, there is no iota of evidence to establish that the petitioner in any manner was

involved in the commission of the alleged offence. Learned counsel further submits that the petitioner is no longer required for custodial interrogation.

5. Learned A.P.P. appearing for the State vehemently opposes the prayer for bail of the petitioner.

From the petition and from the arguments of the parties, I find that the main allegation in this case is that during the fight, the accused persons severely assaulted the deceased and subsequently crushed him to death by trampling him with one of their vehicles. From the records, it appears that the petitioner is a girl aged 18 years and is a student. There is no allegation against the petitioner that she had assaulted the deceased or any member of the rival group nor there is allegation that she was driving the vehicle, which crushed the deceased. There is no allegation also that this petitioner instigated any one of them. The only material against the petitioner is that she was present at the Bar along with companions, some of whom had actively taken part in the assault.

7. Considering the above facts and circumstances of the case, I am inclined to grant bail to the petitioner. Petitioner, namely, Divya Bharti, is directed to be released on bail on furnishing bail bonds of Rs.10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate XXXII at Ranchi in connection with Lalpur Police Station Case No.05 of 2026 (arising out of Garhwa Police Station Case No.00 of 2026), subject to the condition that one of the bailers should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand.
