03/ 16.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 191(2), 191(3), 126(2), 115(2) and 109 of the Bharatiya Nyaya Sanhita.

Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order.

Learned A.P.P. opposes the prayer for bail.

It is alleged that the petitioners along with others came armed with deadly weapon and they assaulted the informant on his head, who was cutting crops in his land. Due to said assault on his head, the informant became unconscious and thereafter, he was taken to hospital where his treatment was done.

After going through the case diary, especially paragraph Nos.33 and 34, which is statements of the independent witnesses, it is clear that there was longstanding land dispute between the parties, for which the parties fought.

Considering the nature of the offence and the fact that there was longstanding dispute, I am inclined to grant bail to these petitioners. Accordingly, the petitioners, named above, are directed to be released

on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned JMFC, Nagar Untari, in connection with Ketar Police Station Case No.80 of 2024 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand.
