The petitioners are apprehending their arrest in connection with Saraidhela P.S. Case No. 218 of 2025, registered for the offence under Sections 127(2), 115(2), 118(1), 117(2), 109, 352/3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Dhanbad.

Learned counsel appearing for the petitioners submits that the petitioners and the informant side are agnates and there are case and counter case between the parties. He next submits that in the case, lodged by the petitioners, the informant’s side have already been granted anticipatory bail. He then submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-15 of the petition.

Learned counsel appearing for the State and learned counsel appearing for the informant jointly opposed the prayer and submit that the allegations are there of making assault, in which, injury has been received by the informant.

Considering that both the sides are agnates and there are case and counter case between both the sides and in the case lodged by the petitioners, the informant’s side have already been granted anticipatory bail and the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-15 of the petition, in that view of the matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
