02/10.04.2026 Heard learned senior counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Chandwa P.S. Case No. 223 of 2025, registered for the offence under Sections 137(1)(a), 308(2), 308(4), 3(5) of Bhartiya Nyaya Sanhita, 2023 and Sections 15, 25 and 29 of the NDPS Act, pending in the Court of learned Special Judge, NDPS, Latehar.

Learned senior counsel appearing for the petitioner submits that the allegations are made in the FIR that on secret information through senior officials, it has come to knowledge that one red coloured Ashok Leyland truck bearing registration no. PB 10 HS 9083 is parked near Devnad river bridge which is loaded with illegal Doda. He submits that only on suspicion, the name of petitioner has come and the petitioner happens to be the recovery Agent of a finance company namely Bharat Repossession Agency. He also submits that the petitioner is not having criminal antecedent. He further submits that the petitioner is nothing to do with the said truck as well as with the alleged loaded contraband.

Learned Special P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on suspicion. On query made by the learned counsel for the State, he fairly submits that in the case diary, it has come that the petitioner is not having criminal antecedent.

Considering that the name of the petitioner has come only on suspicion and the petitioner is said to be the recovery Agent of a finance company namely Bharat Repossession Agency and it has come in the case diary that the petitioner is not having criminal antecedent and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
