Heard learned counsel for the petitioner and learned APP.

The petitioner has been made an accused in connection with S.T. Case No. 270 of 2025 arising out of Chandwa P.S. Case No. 209 of 2025, registered for offences punishable under Sections 74, 76, 78(1), 64 & 62 of the B.N.S., 2023, which is pending in the Court of learned A.S.J.-II, Latehar.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case. It is further submitted that there is case and counter case between the parties with the allegation of assault without any rhyme and reason. It is further submitted that this case was instituted only on the basis of previous animosity between the parties. Petitioner was also involved in eve teasing against the daughter of the informant which was culminated into conviction of this petitioner under section 354A of the I.P.C. and was sentenced with fine of Rs. 10,000 in the case instituted in the years 2021. After lapse of four years of the above incident, this case was instituted only with the allegation that petitioner was eve teasing with the daughter of the informant and upon raising alarm, local villagers assembled there and the petitioner was assaulted by the villagers and handed over to the police. petitioner was assaulted at the instance of the informant on account of retaliation. It is also submitted that the petitioner is in custody since 17.09.2025. Petitioner undertakes to cooperate in the trial of the case and abides by all terms and conditions which may be imposed. Hence, the petitioner may be admitted to bail.

Learned APP has opposed the prayer for bail of the petitioner. 5. Considering the aforesaid facts and circumstances of the case, I find substance in the contentions raised on behalf of petitioner. Therefore, the prayer for bail of the petitioner is allowed. The petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.S.J.-II, Latehar in connection with S.T. Case No. 270 of 2025 arising out of Chandwa P.S. Case No. 209 of 2025 with condition that petitioner shall appear physically on each and every date during the trial of case till its conclusion unless his physical appearance is dispensed with for sufficient cause to the satisfaction of the learned trial court and with further condition that petitioner shall not indulge in tampering with the prosecution evidence or influence the witnesses or gain over them.
