The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 115(2)/ 126(2)/ 127(2)/ 190/ 191(2)/ 191(3)/ 109/ 303(2) of the Bharatiya Nyaya Sanhita (BNS), 2023 and under Sections 3/4 the Prevention of Witch (Daain) Practices Act, 2001.

3. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence as alleged in the FIR. Learned counsel further submits that neither the petitioner was present at the place of occurrence nor has got any concern with the said occurrence but the name of petitioner in the F.I.R. has deliberately been given with an ulterior motive. The petitioner and the informant party are agnates and are having land disputes. During course of investigation, nothing specific has come against the petitioner. He further submits that the petitioner is languishing in custody since 24.09.2025; as such, the petitioner may be enlarged on bail. He is ready to abide by every condition imposed by this court.

4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

5. Having regard to the facts of the case and looking the period of custody; I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond

of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of Sri Satish Kumar Munda, learned Judicial Magistrate, 1^st Class, Godda in connection with Mahagama P.S. Case No. 127/2025.

6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
