High Court of Jharkhand (Division Bench: Tarlok Singh Chauhan, C.J. and Sujit Narayan Prasad, J.; judgment authored by Sujit Narayan Prasad, J.), W.P.(C) No.3560 of 2025, pronounced 08.08.2025: Dismisses a writ petition under Article 226 seeking quashing of the Mines Commissioner's order dated 20.08.2024 in Rev. Case No. 104/2023 and the District Mining Officer, Garhwa's memo no. 1337 dated 16.10.2023 rejecting renewal of a stone-quarry mining lease over 8 acres (Khata No. 59, Mauza Jogiral Khurd) of government land. Holds: (i) Rule 9(च) JMMC Rules, 2004 imposes a complete restriction on renewal/extension on or after 31.03.2022 — even a licence renewed beyond 31.03.2020 has force only up to 31.03.2022 — and grants thereafter can be made only through auction; (ii) Rule 23 JMMC Rules prescribes only the procedure for filing a renewal application under Rule 9(ङ) and cannot override the Rule 9(च) embargo; the provisions must be read harmoniously (following Anwar Hasan Khan, (2001) 8 SCC 540 and Goa Foundation, (2014) 6 SCC 590); (iii) by Rule 9(ज)(12) the embargo applies even to areas below 5 hectares; (iv) the Coordinate Bench order dated 06.02.2025 in Gopal Kumar (W.P.(C) No.6812 of 2024) is per incuriam — it ignored the earlier Coordinate Bench decisions in Ghosh Stone Works, (2023) SCC OnLine Jhar 3182 (29.11.2023) and Rang Nath Singh, W.P.(C) No.4950 of 2024 (10.09.2024) — and hence has no binding effect on grounds of judicial discipline (doctrine explained via State of Orissa v. Mamata Mohanty, (2011) 3 SCC 436 and Hyder Consulting, (2015) 2 SCC 189); (v) within the certiorari limits laid down in Syed Yakoob, Hari Vishnu Kamath and Sawarn Singh, the quasi-judicial orders show no error warranting interference. Petition dismissed; pending interlocutory applications disposed of.
