1. The instant contempt case has been filed against the opposite parties for alleged willful and deliberate noncompliance of the order dated 21.06.2019 passed in W.P.(C) No.3117 of 2018 whereby and whereunder following direction was passed :-

“ 9. Accordingly, the writ petition is disposed of considering the decision as has been stipulated at Paragraph-4 of the impugned order as such the petitioner is at liberty to approach before the Deputy Collector, Land Reforms, Koderma by filing of an appropriate application along with the relevant documents in support of his contention/claim within a period of three weeks from the date of receipt of copy of the order.

10. Upon such application, the concerned authority shall take decision in accordance with law within a period of eight weeks from the date of receipt of such application/representation after providing

opportunity of hearing to the petitioner and other affected parties, if any.”

2. Show cause has been filed wherein the reasoned order passed by the authority concerned in terms of the order passed by writ court dated 21.06.2019 has been appended as Annexure-C.

3. This Court, after taking into consideration the nature of direction passed by the writ court, as would appear from order dated 21.06.2019, pursuant thereto since the decision has been taken by the authority, therefore, there is no need to proceed further in the contempt case.

4. Accordingly, the instant contempt case is dismissed. 5. However, it is left open upon the petitioner to challenge the aforesaid order, if the petitioner so wishes.
