04/09.04.2025 The present writ petition has been filed for issuance of direction upon the concerned respondents to open continuous Khatiyan in the name of the petitioner as well as to make online entry in the website of the State Government and to issue rent receipt in his name with respect to the land appertaining to Khata No. 62 (new Khata No. 92), Plot No. 347 (new Plot No. 359), Mouza-Brindavanpur, Mouza No. 64, P.S-Nirsa, District-Dhanbad, measuring an area of 3.86 Acres.

Learned counsel for the petitioner submits that the said land originally belonged to Tejpal Singh, son of Sher Bahadur Singh, which was subsequently transferred in favour of Md. Yusuf through registered Raiyati Bandobasti Patta (sale deed) No. 9485/9486 on 05.10.1955 and thereafter Md. Yusuf came in peaceful possession of the land, measuring an area of 5.84 Acres. The legal heirs of Late Md. Yusuf, namely, Abdul Latif and others transferred the said land in favour of Gopal Krishna Matto, son of Late Jaylal Matto through registered sale deed No. 2062 dated 10.09.1973 and thereafter Gopal Krishna Matto came in peaceful possession of the same. Subsequently, the petitioner purchased the land in question measuring an area of 3.86 Acres through registered sale deed No. 19027 dated 27.06.1974 from Gopal Krishna Matto and since then he has been in peaceful possession of the same. the petitioner got it mutated in his name vide Mutation Case No. 21(viii)/197879 and accordingly Jamabandi No. 144 was created in his name. Thereafter, he has been paying the rent to the State Government in respect of the same and the rent receipts have regularly been issued in his favour. The petitioner preferred a representation before the respondent No.4 on 14.02.2025 requesting inter alia to make correction in the revenue records as well as for issuance of continuous Khatiyan in his name in terms with Section 18 of the Jharkhand Tenants Holding (Maintenance of Records) Act, 1973 and to make entry of the same in the website of the State Government. The said representation having not been responded by the respondent No.4, the petitioner has been compelled to prefer the present writ petition.

Mr. Mohan Kr. Dubey, learned A.C to A.G appearing on behalf of the respondents, submits that if the petitioner prefers a fresh representation on the present issue before the respondent No.4, an appropriate decision will be taken by the said respondent in accordance with law within a time frame.

Having heard learned counsel for the parties and keeping in view the nature of the prayer made in the present writ petition, without entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent No.4. On receipt of the said representation, the respondent No.4, after verifying the relevant records and on providing an opportunity of hearing to the petitioner, shall take an appropriate informed decision in accordance with law within eight weeks from the date of filing of the said representation.

The present writ petition is accordingly disposed of with the aforesaid liberty and direction.
