The present writ petition has been filed for the following reliefs:-

“i. For issuance of appropriate writ(s)/order(s)/direction(s) particularly in the nature of mandamus directing the respondents not to construct any building or any wall or do any construction upon the land of the petitioner without acquiring the same under the law of the land or without obtaining consent from the petitioner;

ii. For issuance writ/ order/ direction specially writ of mandamus commanding upon respondent stop the construction of building or any other construction upon the land of the petitioner without acquiring the same under the law of the land or without obtaining no objection from the petitioner.”

Since it is a title dispute between State and the raiyat and it requires determination by a competent Civil Court.

In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to work out his remedy in the proper forum.

Learned counsel for the other side have raised no objection.

Permission is accorded.

Accordingly, the present writ petition stands disposed of with the aforesaid liberty.
