Criminal Miscellaneous Petition for modification of an anticipatory-bail order: By order dated 23.01.2025 in A.B.A. No.2947 of 2024 the petitioner had been given the privileges of anticipatory bail subject to surrender before the learned Chief Judicial Magistrate, Hazaribagh within six weeks and deposit of a cash security of Rs.10,000/-, failing which he was not to be enlarged on bail. Owing to paucity of money he could neither deposit the security nor surrender within the stipulated time, but subsequently arranged the money and made the deposit (copy annexed). The High Court allowed the prayer for extension, modified the order dated 23.01.2025 by directing the petitioner to surrender within six weeks from the date of this order, confined the modification to that extent only, and disposed of the petition accordingly.

This Criminal Miscellaneous Petition has been filed by the petitioner with a prayer for modification of the order dated 23.01.2025 passed in A.B.A. No.2947 of 2024.

It is submitted by the learned counsel for the petitioner that vide order dated 23.01.2025 passed in A.B.A. No.2947 of 2024, the petitioner was given the privileges of anticipatory bail and directed to surrender in the court learned Chief Judicial Magistrate, Hazaribagh within six weeks and upon depositing of a Cash Security of Rs.10,000/-, the petitioner was to be enlarged on bail. It is next submitted that due to paucity of money, the petitioner could not make the said deposit within the stipulated time, hence, he could not surrender within the stipulated time. It is next submitted that in the meantime the petitioner has arranged the money and made the said deposit, the copy of which has been annexed with this criminal miscellaneous petition. It is further submitted that now the petitioner is ready and willing to surrender before the learned court below and unless six weeks’ extension is granted to him, he will be highly prejudiced. Hence, it is submitted that the time period for the petitioner to surrender before the court below in terms of the order dated 23.01.2025 passed in A.B.A. No.2947 of 2024 be extended by six weeks from the date of this order.

Accordingly, the order dated 23.01.2025 passed in A.B.A. No.2947 of 2024 is modified by directing the petitioner to surrender within six weeks from the date of this order, in terms of the order dated 23.01.2025 passed in A.B.A. No.2947 of 2024.
