The present criminal miscellaneous petition has been filed for modification of the order dated 11.12.2024 passed in A.B.A. No. 7536 of 2024 as well as for extending the time granted to the petitioners to surrender before the concerned court below and to furnish bail bond.
2. Learned counsel for the petitioners submits that in paragraph-1 as well as prayer portion of A.B.A. No. 7536 of 2024, it was wrongly mentioned that Sakchi P.S. Case No. 166 of 2020 corresponding to G.R. No. 159 of 2021 was pending in the court of Additional Sessions Judge- IV, Jamshedpur. In fact, the said case is pending in the court of S.D.J.M., Jamshedpur. The said fact has been mentioned in paragraph-5 of the present Cr.M.P. It is further submitted that due to wrong mentioning of the description of the court in paragraph-1 as well as prayer portion
of A.B.A. No. 7536 of 2024, the same was also mentioned as “Additional Sessions Judge-IV, Jamshedpur” in paragraph-5 of the order dated 11.12.2024 passed in A.B.A. No. 7536 of 2024. Resultantly, the petitioners in spite of being granted anticipatory bail, could not surrender before the concerned court below and furnish bail bond. Under the said circumstance, the description of the concerned court below as mentioned in paragraph-5 of the order dated 11.12.2024 passed in A.B.A. No. 7536 of 2024 may accordingly be corrected and the time granted to the petitioners to surrender before the concerned court below as well as to furnish bail bond may also be extended.

Having heard learned counsel for the parties and for the reasons stated in the present Cr.M.P., the description of the court below mentioned in paragraph-5 of the order dated 11.12.2024 passed in A.B.A. No. 7536 of 2024 is corrected to be read as “S.D.J.M., Jamshedpur.” Accordingly, the time granted to the petitioners to surrender before the concerned court below and to furnish bail bond is also extended till 04.04.2025.
