Contempt (Civil) No. 366 of 2023 (Jharkhand HC, Ranchi; Rajesh Shankar, J.; decided 11.07.2025): Contempt application against the Deputy Commissioner, Jamshedpur (East Singhbhum) (O.P. No. 2) alleging wilful disobedience and non-compliance of the High Court's order dated 31.01.2023 in W.P.(C) No. 6250/2022. Through his show cause affidavit dated 17.07.2023 (paras 9-10), O.P. No. 2 submitted that, upon the petitioner's representation, Misc. Case No. 151 of 2022-23 was registered and disposed of by order dated 12.05.2023 directing the Circle Officer, Jamshedpur to demarcate the petitioner's land; the demarcation was done in the petitioner's presence and communicated by Letter No. 1054 dated 03.07.2023 with demarcation report and trace map. Accepting that compliance had been effected, the Court held there was no need to proceed further, dropped the contempt proceeding against O.P. 15/11.07.2025 The present contempt application has been filed against the O.P.No.2 alleging wilful disobedience and non-compliance of the order dated 31.01.2023 passed by this Court in W.P.(C) No. 6250/2022.

Ms. Nirupama, learned A.C to Sr. S.C-II appearing on behalf of the O.P.No.2, refers to paragraphs 9 & 10 of the show cause affidavit dated 17.07.2023 filed on behalf of the said opposite party, which read as under:

‘’09. That it is submitted that after receiving representation of the petitioner submitted in the light of the order dated 31.01.2023 of this Hon’ble Court along with copy of the said order dated 31.01.2023, the opposite party no.2 registered Misc. Case No. 151 of 2022-23 and after noticing all the concerned parties and after hearing the concerned parties, disposed of said Misc. Case No. 151 of 2022-23 by appropriate order dated 12.05.2023 directing the Circle Officer, Jamshedpur to demarcate the land of the applicant as mentioned in representation and to provide the demarcation report along with the map to the applicant.

That it is stated that in compliance of the order dated 12.05.2023 of Misc. Case No. 151 of 2022-23, the demarcation of the said land has been done in presence of the petitioner and further communicated through Letter No. 1054 dated 03.07.2023 with demarcation report and trace map.’’

It is thus submitted that the aforesaid order of this Court has now been complied by the O.P.No.2.
