The petitioner has been made accused in connection with C.I.D. P.S. Case No. 44 of 2024 for the offences registered under Sections 316(5), 318(4), 338, 336(3), 340(1), 340(2), 61(2) & 111(4) of the B.N.S., pending in the court of Sri Prabhat Kumar Sharma, learned Special Judge, C.I.D., Ranchi.

Rs. 40,50,00,500/-was deposited in Central Bank of India, Birsa Chowk Branch by Jharkhand Urja Utpadan Nigam Limited. It appears that in connivance with the bank employees of Central Bank of India, a fake account was opened and the entire amount was transferred in the said fake account. It further appears that the Branch Manager Lolas Lakra, had enticed the General Manager of Jharkhand State Electricity Employees Master Trust to deposit the amount in fixed deposit scheme. It appears that this entire amount was embezzled and forged fix deposit receipts were given to the informant. The informant on being suspicious, visited the bank to enquire about his money. Later, it transpired that the entire amount was embezzled with the connivance of bank officials and officers of Jharkhand Urja Utpadan Nigam Limited.

It was submitted that the petitioner is neither a Bank employee, nor he was employee of Jharkhand Urja Utpadan Nigam Limited. It was further submitted that only allegation against the petitioner is that he is an employee of a Chartered Accountant Firm, and

introduced two officials of Jharkhand Urja Utpadan Nigam Limited to the Bank Manager of Central Bank of India. It was finally submitted that similarly situated co-accused persons have been granted bail by this Court as well as by Co-ordinate Bench of this Court.

Mr. Md. Shahabuddin, learned SC-VII appearing for the State has vehemently opposed the prayer for bail.

In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/(Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri Prabhat Kumar Sharma, learned Special Judge, C..I.D, Ranchi, in connection with C.I.D. P.S. Case No. 44 of 2024.
