2. The petitioner is apprehending his arrest in connection with Chhattarpur P.S. Case No.33 of 2025 corresponding to N.D.P.S. Case No.18 of 2025, for the alleged offences registered under Sections 8(B), 18(B), 27(a), 28 and 29 of N.D.P.S. Act pending in the Court of learned Special Judge N.D.P.S. Act, Palamau.

3. Learned counsel appearing for the petitioner submits that in the FIR the nature of land and name of raiyat of land is not disclosed. He further submits that vague allegation is made against the petitioner that the petitioner was cultivating the poppy plant in the land. He then submits that the petitioner is Mukhiya of Kawal Panchayat and only due to that the petitioner has been implicated in the case. He next submits that the petitioner has got no criminal

4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioner of cultivation of poppy plant.

Looking into the contents of the FIR it transpires that Khata No.176 is disclosed and it has been pointed out in the course of argument that the said khata is recorded in the name of ancestor of the petitioner, however, in the FIR it has been further disclosed that the said land is illegally occupied by Ramjanam Singh, Parmeshwar Singh and Nayan Singh and the petitioner has got no criminal antecedent as disclosed in paragraph No.12 of the petition, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Special Judge N.D.P.S. Act, Palamau in connection with Chhattarpur P.S. Case No.33 of 2025 corresponding to N.D.P.S. Case No.18 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
