2/05.12.2025 Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State through V.C.

The petitioner is apprehending his arrest in connection with Dhalbhumgarh P.S. 49/2023 registered u/s 5/12 of Jharkhand Bovine Animals Prohibition of Slaughters Act, 2005 and u/s 11 of Prevention of Cruelty to Animals Act, 1960, pending in the court of learned A.C.J.M at Ghatsila.

Learned counsel appearing for the petitioner submits that the name of the petitioner is Samjad Ali, whereas the FIR is against Samjed Ali and the petitioner is residents of another village, whereas in the FIR, the petitioner is shown to be the resident of Jubisor. He further submits that the petitioner is nothing to do with the bovine animals. He next submits that earlier one case of different nature was registered against the petitioner and the petitioner was acquitted in that case and that has been disclosed in Para 11 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that petitioner is named in the FIR.

Considering that petitioner is resident of another village

whereas in the FIR, residence of the petitioner is shown Jubisor and it has been pointed out that the petitioner is nothing to do with the bovine animals; I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/(Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned A.C.J.M at Ghatsila, in connection with Dhalbhumgarh P.S. 49/2023, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

This Anticipatory Bail Application is accordingly allowed and disposed of.
