05 /04.07.2025 I.A. No.4920 of 2024 has been filed for condoning the delay of 93 days in filing of the C.M.P.

Learned counsel appearing for the petitioners submits that the M.A. No.446 of 2018 was dismissed for non-compliance of the preemptory order and according to him that pre-emptory order was passed on 29.01.2020 and due to covid-19 the said were not removed within time and in view of that the said delay has occurred in filing of the C.M.P.

3. Learned counsel appearing for the State has got no serious objection if the delay of 93 days is condoned.

4. The Court finds that sufficient ground is made out for condoning the delay of 93 days considering the Covid-19 was prevalent at that time, as such the delay of 93 days is hereby condoned.

5. I.A. allowed and disposed of.

6. This C.M.P. has been filed for restoration of M.A. No.446 of 2018 which was dismissed for non-compliance of pre-emptory order.

7. For the reasons assigned in the C.M.P., the Court finds that sufficient ground is made out to restore the said M.A., as such M.A. No.446 of 2018 is restored to its original file.

8. This C.M.P. is disposed of.
