The petitioner has been made accused in connection with Nimdih P.S. Case No.46 of 2022 corresponding to G.R. No.262 of 2022 registered for the offences punishable under Section 302 of the Indian Penal Code.

Learned senior counsel for the petitioner submits that the allegation against the petitioner is that the petitioner committed murder of Shivcharan Singh. It is submitted that the allegation against the petitioner is false. It is next submitted that so far 5 witnesses have examined and they were stated about the petitioner assaulted with lathi and the petitioner has been seen fleeing away from the place of occurrence, immediately after the occurrence and the dead body of the deceased was lying at a place from where the petitioner fled away. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-12 of this bail application. It is also submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 14.10.2022 as is evident from para-05 of the instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view the overwhelming evidence that has come during the trial of the case; there is every chance

of the petitioner absconding, if released on bail. It is therefore submitted that the petitioner ought not be released on bail.

Considering the serious nature of allegation against the petitioner as well as the evidence that has come against him through the witnesses examined in this case and the chance of the petitioner absconding, if released on bail, this Court is not inclined to admit the petitioner on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected.
