The impugned notice/ order as contained in Memo No.2316 dated 23.11.2015, issued by Mango Notified Area Committee and notice/ order as contained in Memo No.3518 dated 23.11.2015, issued by Jamshedpur Notified Area Committee published in the Hindi daily “Prabhat Khabar”, Jamshedpur Edition dated 24.11.2015, (Annexure – 7) reads as under :-

3. The impugned orders are press release. The law is settled on the point. An effective order can only be passed after going through a procedure. A result can only be produced after going through a prescribed procedure before an authorized officer. This is the concept of rule of law. An order which is affecting the rights of the parties without going through a procedure, i.e., without initiating any proceeding is ipso facto without jurisdiction. Initiation of a proceeding is jurisdiction. To affect a person, one or other individual, individual notice is must when single right is being taken away.

4. Admittedly, in the present case there is no proceeding. In the absence of any proceeding, the impugned orders/ notices contained in Memo No.2316 dated 23.11.2015 and Memo No.3518 dated 23.11.2015 are a nullity. Declaring so, the present writ petition is, hereby, disposed of.

5. However, the parties are at liberty to work out their remedy in accordance with law.

¶27

6. Pending interlocutory application, if any, also stands disposed of.
