2. This writ petition has been filed for the following reliefs:

“a. For direction upon the respondents to consider the case of petitioner for payment of the monetary compensation to the petitioner from date of death of her husband in terms of Para 9.5.0 of National Coal Wage Agreement as the husband of the petitioner was in the service of C.C.L. and died in harness on 17.07.2015.

b. For further direction upon the respondents for payment of arrear of monetary compensation and other retiral benefits along with appropriate cost and interest from the date of death of the husband of the petitioner. AND / OR

To pass such other order / orders as your lordship may deem fit and proper for doing justice, in fact of present case.”

The learned counsel for the petitioner submits that the son of the petitioner had filed a writ petition for grant of compassionate appointment and some order has been passed in his favour by the writ court and, therefore, the grievance of the petitioner with regard to monetary compensation does not survive anymore and accordingly,

the present writ petition has become infructuous and he does not want to press it.

4. At this, the learned counsel for the respondents has submitted that so far as gratuity and other retiral benefits are concerned, the petitioner is still in occupation of the quarter and the respondents are ready to pay the same as and when the quarter is vacated.

5. To this, the learned counsel for the petitioner submits that he has no instruction but so far as the writ petition is concerned, he does not want to press it.

6. Considering the aforesaid submissions, this writ petition is dismissed as not pressed.

7. Pending interlocutory application, if any, stands closed.
