At the very outset, learned counsel representing State submits that a copy of supplementary counter affidavit has already been served to the counsel appearing on behalf of the petitioner but the same could not be filed in time and as such prays for acceptance of the same.

Supplementary Counter affidavit is taken on board. Let it be kept with records.

Petitioner is claiming benefits of MACP as well as arrears of second MACP and third MACP.

Learned counsel appearing on behalf of the petitioner draws attention of this Court towards paragraphs-11 and 12 of the counter affidavit and submits that it is specific stand of the respondents that though the amount has been admitted but in want of sanction, the same could not be paid to the petitioner. Learned counsel further argues that a direction may be given to the respondents for extending the benefits claimed by the petitioner.

Learned counsel representing State argues that as and when amount is sanctioned, the benefits shall be extended to the petitioner.

Let the entire benefits be extended to the petitioner within a period of eight weeks from the date of receipt/ production of a copy of this order, if there is no other legal impediments. Respondent no. 1 is directed to take necessary steps for sanction of fund at the earliest.

With the aforementioned observations and directions, the writ petition stands disposed of.
