At the very outset, Mr. Nehru Mahato, AC to learned GP-IV submits that a copy of counter affidavit has already been served to the counsel appearing on behalf of the petitioner but the same could not be filed in time and as such prays for acceptance of counter affidavit.

Counter affidavit is taken on board. Let it be kept with records.

Petitioner is claiming benefits of MACP.

At the very outset, learned counsel for the petitioner submits that from the counter affidavit it transpires that grievance of the petitioner has already been accepted and as petitioner has submitted all the documents, the respondents shall take necessary steps for payment of MACP as and when Vigilance Clearance is given. Learned counsel for the petitioner further argues that the documents regarding vigilance clearance has already been annexed by way of supplementary affidavit. The respondents may take into consideration the said documents and pass necessary orders regarding extending benefits of MACP.

Let the entire exercise be completed within a period of six weeks. Needless to say, if petitioner is found entitled for the said benefits, the same is directed to be extended within the aforesaid period.

With the aforementioned observations and directions, the writ petition stands disposed of.
