This second appeal is preferred against the judgment and decree passed in Title Appeal No. 20 of 2003 by which the judgment and decree passed in Title Suit No. 9 of 1993 was reversed and the plaintiff’s suit for title and eviction was dismissed by the appellate Court. Aggrieved by the judgment and decree passed by the first appellate Court, the instant second appeal is preferred by the plaintiff.

It is submitted by the learned counsel on behalf of the appellants that during pendency of the second appeal, the matter has been amicably settled between the parties and a joint compromise is filed by the way of interlocutory application No. 5882 of 2024. The interlocutory application has supported by affidavits shown separately by both sides by way of I.A. in this appeal. The terms of the settlement are set out in a para 4 to 9 of the interlocutory application No. 5882 of 2024.

Learned counsel appearing on behalf of the respondents admits about the factum of the settlement arrived between the parties.

Having considered the submissions made and the joint compromise petition filed on behalf of both sides. The second appeal is disposed of in terms of the

compromise as set out in interlocutory application No. 5882 of 2024 which is registered to drawn a decree in terms of the joint compromise petition filed by way of interlocutory application.

Accordingly, second appeal is dismissed.
