08/19.01.2024 The present contempt petition has been filed for initiating a contempt proceeding against the contemnors/opposite parties alleging willful disobedience of order dated 24.06.2016 passed in W.P.(Cr.) No. 67 of 2016.
2. Mr. Rahul Saboo, learned GP-II appearing on behalf of the opposite party no. 2, refers to paragraph no. 5 of the show cause affidavit dated 23.11.2021 filed on behalf of the opposite party no. 2 (wrongly mentioned as opposite party no.
3), which reads as under:
5. That it is most respectfully stated and submitted that pursuant to the direction of this Hon’ble Court, the preliminary enquiry No. 01/2012 was concluded and final progress report was submitted on 22.12.2016 in which the pending preliminary enquiry against the accused Shailendra Kumar Singh was closed. It is further stated that the Vigilance Bureau has found that there is no sufficient evidence against the accused Shailendra Kumar Singh and thus the Vigilance Bureau has decided to close the preliminary enquiry against the accused Shailendra Kumar Singh.
Photocopy of the final progress report dated 22.12.2016 is annexed and marked as Annexure-X.
3. Considering the said statement made in the show cause affidavit dated 23.11.2021, there is no need to further proceed in the contempt petition. The contempt proceeding as against the opposite party no. 2 is hereby dropped.
4. The contempt petition is accordingly disposed of.
