This bail application has been filed on behalf of the applicant– Pintu Singh with prayer to release on bail in connection with Barwadih P.S. Case No. 33 of 2024, corresponding to G.R. Case No. 399 of 2024 registered under section 302 of the Indian Penal Code subsequently chargesheet has been submitted u/s 304 of IPC, pending in the court of learned Judicial Magistrate 1^st Class, Latehar.

The FIR of this case was lodged by the wife of deceased with these allegations that on 17.04.2024 at 8 O'clock she was alongwith her two children in a marriage ceremony in tola Awratikka. There she had received a phone call from her husband who told her that he had sustained foot injury caused by glass and blood was oozing and it appeared he would die. She reached to her husband and found the blood oozing from his right leg. She gave the first-aid by wrapping her stoll on the injury and then her Bhasur took her husband to the community health center Barwadih where he was declared dead and later on it came to know that Pintu Singh had assaulted with the bottle which hit to the leg of her husband and who consequently died.

In case diary the statement of Rajmohan Singh was recorded who is father of petitioner. He has stated that he alongwith Amin Singh and

deceased Ramraj Korwa all were drinking wine. In the meantime, his son Pintu Singh came there who enraged having seen them drinking wine and he threw the wine bottle which ultimately was broken and hit to Ramraj Korwa’s right leg and they did not care since it might cause simple injury as Ramraj Korwa had gone to his house. Same kind of statement is given by Lalita Devi, Vishwanath Singh and Amin Singh as well.

In postmortem report of deceased there are three antemortem external injury, one is cut injury in right foot another bleeding from left the ear, abrasion on the chest and an internal injury in skull and brain, the frontal bone is shown fractured and cause of death is shown cardiorespiratory failure due to neurogenic as well as hemorrhagic shock due to trauma caused by hard and blunt object. The medical evidence is also found to be contrary to the ocular evidence as collected by the investigating officer.

In view of the above, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
