The petitioner is apprehending his arrest in connection with Kadma P.S. Case No.98 of 2023 registered under Sections 409/419/420/120B/34 of the Indian Penal Code, 1860.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. As per the allegation, co-accused-Dhiraj Kumar Jha, ExBranch Manager, Bank of India, Uliyan branch, Kadma, Jamshedpur in collusion with one Nitish, Ex-Branch Manager of Gohaldangra Branch of the said bank, by misusing the post and violating the norms of the bank sanctioned loans and overdraft loans against TDR (Term Deposit Receipt) to 33 customers between the period from 9^th October, 2020 to 3^rd March, 2023 amounting to Rs.924.29 lakhs. It is further submitted that co-accusedRavi Kant Sinha open two loan accounts i.e. account

nos.454627320000002 & 4553611100001058 against the current accounts of the petitioner i.e. account nos.450020110001003 & 593910110005025 of Bank of India and Bank of Baroda respectively. Thereafter, Ravi Kant Sinha transferred the loan amount to the current accounts of the petitioner without his knowledge. Hence, the petitioner cannot be said to beneficiary of the said amount. The petitioner had no dishonest intention to misappropriate any amount as he only provided access of his current bank accounts to co-accused-Ravi Kant Sinha under bona-fide belief that the said amount was earned by him through legal means. Co-accused Deepa Sinha has already been granted anticipatory bail by this Court vide order dated 2^nd September, 2024 passed in A.B.A. No.10220 of 2023. The petitioner has no criminal antecedent as has been stated in paragraph no.19 of the present anticipatory bail application. He undertakes to cooperate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail.

Learned A.P.P. opposes the petitioners’ prayer for grant of anticipatory bail.

Having heard learned counsel for the parties and on consideration of the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner, above named, in the event of

his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamshedpur in connection with Kadma P.S. Case No.98 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
