This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Maranghada P.S. Case No.31 of 2023 registered under Sections 302/201/120-B of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Khunti.

The F.I.R. of this case was lodged by the son of the deceased with these allegations that he had talked with his mother Sundarmani on 16^th November, 2023 at 3.15 over the mobile phone from Bangalore. On 18^th November, 2023, he received a phone call from his elder brother Etwa Pahan in regard to missing of his mother and he tried to make call on the mobile phone of his mother but same came switched off. On 19^th November, 2023 in evening when he reached at Ranchi Airport his brother Etwa Pahan called him and informed that after hectic search, the mother was found dead in the dry drain of Baru Buru forest towards the north about one kilometer from the village. On 20^th November, 2023, he along with his brother reached to the place where the dead body of his mother was lying and with the help of police the same was brought out. It appeared that she was assaulted by some sharp edged weapon. Hence, this F.I.R. was lodged.

This F.I.R. was lodged against the unknown miscreants. During investigation witness, Birsa Munda had stated that on 17^th November, 2023 he had seen that Mahadeo Munda, Lukin Munda, Lorsingh Baraik, Pandu Munda, Raswal Munda and Duna Munda were drinking wine. At that time

Mahadeo Munda was saying that he had taken one tractor stone from Gashiram Munda to build his Well and for the same mother of Gashiram Munda, namely, Sundarmani used to taunt him. On this Lorsing Baraik has also told that he is also constructing a house and Sundarmani was obstructing for the same and they decided to finish her.

Next day on 18^th November, 2023 at 1 o’ clock he had seen Sundarmani going towards the Jungle and after sometime the accused Mahadeo Munda, Lukin Munda, Lorsingh Baraik, Pandu Munda, Raswal Munda and Duna Munda had also followed her. At 6.30 he came to his house and again saw all these accused persons coming from the side of Jungle and all were murmuring that not leave their house. Thereafter Etwa Munda came to him making search of his mother.Same kind of statement is given by Parau Munda and Lusa Munda.

Thereafter all these accused persons were nabbed by the police and their confessional statements were recorded. On confessional statements of Mahadev Munda, Lukin Munda and Bovasi Munda @ Bausih, dauli and wooden stick which were alleged to have been used in commission of murder of mother of the informant were recovered.

On perusal of case-diary, it appears that there is no evidence except the statements of said witnesses who had seen the deceased going towards the jungle and thereafter the accused were also following them. 5. In view of the submissions made and materials on record, the bail application of the petitioner is, hereby, allowed. Let the petitioner be released on bail on furnishing bail bond of Rs.30,000/-(Rupees Thirty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
