03/14.08.2024 Heard learned counsel for the applicant, learned A.P.P. for the State and learned counsel for the informant.

This bail application has been filed on behalf of the applicant– Rajkumar Singh @ Raja Singh with prayer to release on bail in connection with Itkhori P.S. Case No.16 of 2024 registered under Sections 147, 149, 341, 323, 307, 452 and 302 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate, Chatra.

The FIR of this case was lodged against the 12 named accused with these allegations that all the 12 named accused on 17.02.2024 at 8 O'clock in night came to the house of informant Pawan Kumar Dangi and all began to assault the brother of informant Mithilesh Dangi with the stick, iron rod and the brother of informant also sustained head injury. He was taken to hospital who during the treatment died.

As per allegations made in FIR, the informant is the eye witness of the occurrence. In the FIR itself, no role has been attributed to the present petitioner. The name of petitioner transpired for the first time in view of para 45 of case diary in the application given by the informant Pawan Kumar Dangi to the SSP, Chatra wherein he has shown the involvement of petitioner Raja Singh in commission of the said offence. There is no other corroborating evidence.

In view of the above, the bail application of the applicant is

hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.30,000/-(Rupees Thirty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
