Heard learned counsel for the petitioner and the learned A.P.P. appearing on behalf of the State.

The petitioner is an accused in connection with Jaldega (Orga O.P.) P.S. Case No. 25 of 2024, dated 21.05.2024, registered for the offence punishable under Sections 420, 467, 468, 414 of the Indian Penal Code and the case is presently pending before the Court of learned Sub-Divisional Judicial Magistrate, Simdega.

It is submitted on behalf of the petitioner that as per the allegation in the F.I.R. the petitioner is alleged to have been involved in running a stolen vehicle i.e. pickup van with fake registration number. It is also submitted that the said pickup van in question was given to him by a co-accused namely Mahesh Sahu and he has no knowledge about its genuineness and the main culprit, if any, is Mahesh Sahu and not the petitioner.

Further, it has been submitted that this petitioner is in jail since 22.05.2024 and he has no criminal history as stated by the learned counsel in para-14 of the bail application.

Learned counsel has further submitted that charge-sheet in this case has been submitted and therefore, there is no possibility of tampering the evidence. 6. On the other hand the learned A.P.P. appearing on behalf of the State has opposed the contentions raised on behalf of the petitioner and submitted that it was the petitioner who was running the stolen vehicle i.e. the pickup van by using fake registration number which was belonging to one Sandeep Kumar Gupta of Allahabad and therefore, he does not deserve to be enlarged on bail

but he did not deny the fact that the said vehicle was given to this petitioner by Mahesh Sahu on rent.

Having heard the parties, perused the records of this case.

In the light of the submissions advanced on behalf of the parties and under the facts and circumstances of this case, this petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Sub-Divisional Judicial Magistrate, Simdega, in connection with Jaldega (Orga O.P.) P.S. Case No. 25 of 2024, subject to the condition as laid down under Section 439 of the Cr.P.C. and further, subject to the condition that the petitioner will appear before the learned Court below on each and every date as and when required, failing which, appropriate order shall be passed by the learned Court below for the cancellation of the bail.
