The petitioner is an accused in connection with Jamtara Cyber Crime P.S. Case No.31 of 2024, dated 11.05.2024, registered under Sections 414, 419, 420, 467, 468, 471 & 120-B of the Indian Penal Code and Section 66 (B) (C) (D) of the Information Technology Act, pending in the Court of Learned Additional Sessions Judge-I, Jamtara.

It is submitted on behalf of the petitioner that the gist of the allegations as unfolded in the F.I.R. is that on the basis of secret information, the house of the petitioner was searched where several mobile phones and sim cards were recovered and on the basis of confessional statement of this petitioner, the F.I.R. was instituted in which the petitioner is one of the accused along with the named co-accused-Ranjeet Mandal. It has been pointed out that no victim has come forward to substantiate the allegations as made in the F.I.R. and the similarly situated co-accused-Ranjit Mandal @ Ranjeet Mandal is said to have been enlarged on bail by the Co-ordinate Bench of this Court vide B.A. No.5737 of 2024 dated 01.08.2024. It has further been stated in Para 23 of the bail application that he has no criminal history. Further, it has been stated that in para 24 of the petition that the petitioner is in jail since 12.05.2024 and it is also submitted that the chargesheet in this case has been submitted and therefore the possibility of

tempering with the evidence is very remote and therefore, this petitioner deserves to be enlarged on bail.

On the other hand the learned A.P.P. appearing on behalf of the State has opposed the contentions raised on behalf of the petitioner and submitted that there is huge recovery from the house of this petitioner about 4 mobile phones and six sim cards and therefore, the allegation is that on the basis of fake sim he used to defraud so many innocent persons under the guise of the payment of electricity bill and therefore, the petitioner does not deserve to be enlarged on bail. Although, he did not controvert this fact that the similarly situated co-accused person named Ranjit Mandal @ Ranjeet Mandal have been enlarged on bail vide B.A. No.5737 of 2024 dated 01.08.2024 by the Co-ordinate Bench of this Court.

Having heard the parties, perused the records of this case. 6. In the light of the submission advanced on behalf of the parties and under the facts and circumstances of this case, this petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five thousand) with two sureties of the like amount each to the satisfaction of the Court of Learned Additional Sessions Judge-I, Jamtara, in connection with Jamtara Cyber Crime P.S. case No.31 of 2024, subject to the condition that the petitioner will submit self-attested photocopy of his/her/their Aadhar Card(s) and also submit his/her/their mobile number(s) before the learned Court below which he/she/they will always keep active and will not change it during pendency of this case without permission of the Court, failing which, appropriate order shall be passed by the learned Court below for cancellation of bail.
