Heard learned counsel for the petitioner and learned APP for the State.

This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Chanho P.S. Case No.18 of 2024, corresponding to POCSO Case No. 38 of 2024 registered under sections 341, 324, 326 and 354(B) of the Indian Penal Code and Sections 10 and 12 of the POCSO Act, pending in the court of learned Additional Judicial Commissioner Special Judge, POCSO, Ranchi.

As per the allegations made in the FIR, the informant-victim 15 years old was going to her house from the school on 25.01.2024 at 01:40 O’clock of day time near Pathhar Khadan, Padhaiya, the petitioner Roshan Gope met her and intercepted her bicycle and with intent to outrage her modesty, cut on her cheek and also stated that he would marry with her. On hearing cry, the accused fled away.

The victim in her statement recorded under Section 161 of Cr.P.C., reiterated the averment made in the FIR itself, the same is also corroborated with the statement of Sanjay Munda. The maternal uncle and the maternal grandmother of the victim have also corroborated the prosecution story. In view of the medical examination report, the nature of injury is shown simple.

In view of the materials on record and the submissions made by the learned counsel for the parties, the bail application of the petitioner is hereby allowed. Let the petitioner be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty-Five thousand) with two sureties of like amount to the satisfaction of the court concerned in the aforesaid case.
