Heard learned counsel for the applicant and the learned A.P.P. for the State.

This bail application has been filed on behalf of the applicant- Molai Santara @ Malai Santara @ Molay Santara with the prayer to release on bail in connection with Mango P.S. Case No. 33 of 2024 (S.T.No.241 of 2024), registered under Sections 302/120-B and 34 of the Indian Penal Code and under Section 27 of the Arms Act, pending in the Court of the Additional Sessions Judge-I, Jamshedpur.

The F.I.R. of this case was lodged against the 09 named accused including the present petitioner and unknown persons with these allegations that on 02.02.2024 at 03:30 O’ clock, the informant was purchasing some worshiping articles from the shop. He saw his son Raja Kumar along with Aman Singh and Baldip Singh coming out of the salon situated at Baikunth Nagar Road No.3. They were on the splendor

motorcycle and at the same time he also saw Ankit Bachcha, Pravir Singh @ Chhotu and Rahul Bachcha opening fire on the son of the informant Raja Kumar who in order to rescue himself intruded in the plastic shop and further the accused Ankit Bachcha, Pravir Singh @ Chhotu and Rahul Bachcha also intruded in the very shop and shot the son of informant. Along with them were also Arjun, Rahul Rai, Sunil Thakur, Abhishek Kumar @ Abhishek Singh @ Lad, Balvinder Singh @ Golu and Aakash Kumar @ Baba Bachcha. Thereafter all managed to flee away and the accused persons were also identified by the friends of his son namely Aman Singh and Baldip Singh as well. Son of informant was taken to Hospital where he was declared dead.

The petitioner is not named in the F.I.R. His name transpired during investigation in confessional statement of co-accused Balvinder Singh @ Golu. Admittedly, there is no other evidence against the petitioner except the confessional statement of co-accused. The named accused Abhishek Kumar @ Abhishek Singh @ Lad has already been granted bail in B.A.No.6638 of 2024 vide order dated 14.08.2024 by this Bench.

The learned A.P.P. opposed the contentions made by the learned Counsel for the petitioner but conceded on the point of parity.

record, the bail application of the petitioner is allowed. Let the applicant be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in the aforesaid case.
