Heard the parties.

The petitioner has been made accused in connection with Lawalong P.S. Case No.15 of 2022, for the offences registered under Sections 18, 27(a), 28 and 29 of the NDPS Act, pending in the court of learned Sessions Judgecum-Special Judge, NDPS, Chatra.

On 08.02.2022, Lawalong police on the basis of confidential information that poppy was cultivated at Sulma Protected Forest Area raided the aforesaid place and destroyed the poppy cultivation.

It was submitted that though petitioner is named in the F.I.R., his name has transpired on the basis of confession of co-accused persons. It was further submitted that similarly situated co-accused person has been granted bail by Co-ordinate Bench of this Court vide B.A. No.3128 of 2021.

Learned A.P.P. has opposed the prayer for bail, but conceded the aforesaid fact.

Considering the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS, Chatra in connection with Lawalong P.S. Case No.15 of 2022.
