The petitioner has been made accused in connection with Taljhari P.S. Case No.66 of 2022, for the offences registered under Sections 147, 148, 149 and 302 of the Indian Penal Code, pending in the court of learned SubDivisional Judicial Magistrate, Dumka.

F.I.R. was instituted on the basis of fardbeyan of chowkidar Shibu Tudu alleging therein that on 16.10.2022 at about 6:00 A.M., he received information that local villagers of Kaparjora had committed murder of unknown person. On the basis of this information, the informant went to the place of occurrence and found the dead body of an unknown person lying near a tree.

It was submitted that petitioner is not named in the F.I.R. It was further submitted that during the course of the investigation, it has transpired that the deceased, after entering into the village at night, used to outrage the modesty of women folks. The villagers were in the look out of the deceased and on the fateful night, he was apprehended at the place of occurrence. It was further submitted that there is no specific allegation against the petitioner.

Mrs. Nehala Sharmin, learned Spl.P.P. has opposed the prayer for bail and submitted that the name of the petitioner has come in confession of coaccused persons.

Considering the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dumka in connection with Taljhari P.S. Case No.66 of 2022.
